Terms and Conditions of Use and Acceptable Use Policy

By using this website, you agree to abide by these terms and conditions of use (hereinafter referred to as the “Conditions”) as well as the Acceptable Use Policy (“AUP”) described below. If you refuse to abide by the Conditions, please exit this site. D2C Media has the right, but not the obligation, to monitor or investigate compliance with the AUP terms elaborated below or any other agreement between you and D2C Media governing your use of the Website or any other integrated services (collectively the “Services”).
1.0 Acceptable Use Policy
The Services (including any device, system or account used in connection with the Services) may not be used for the following prohibited activities:

a. Illegal activities: Violation of any applicable laws, including Canadian Federal and Provincial laws or regulations, or any applicable foreign law.

b. Infringing activities: Infringement, misappropriation, or any violation of D2C Media’s rights, including intellectual property and privacy rights, or display of or use of D2C Media’s trademarks or other service marks without consent.

c. Interfering activities: transmission of viruses or any materials such as Trojan horses, worms, malware, spyware or any other programs that may be harmful or dangerous or otherwise interfere with the proper functioning of the Services.

d. Traffic falsification activities: Use of bots or other agents or brute force actions designed to inflate page views or falsify leads or use statistics or any other deceptive commercial practices or activities.

e. Objectionable activities: Any indecent, offensive, threatening, harassing, defamatory, libelous, fraudulent, malicious, disruptive, tortious, or other objectionable act including the use of false or misappropriated identification, forged addresses or headers or supplied information that is provided to mislead D2C Media about the user’s identity or origin.

f. Spam: All transmission of unsolicited commercial electronic messages without the recipient’s consent.

The list above is not exhaustive or exclusive. For the purposes of this AUP, “End User” means an individual user of the Services, and may be a natural person and/or may include but is not limited to a user’s employees, consultants, clients, external users, invitees, contractors and agents.

D2C Media makes no representations and provides no guarantees as to the accuracy of the information contained on this website and expressly disclaims any obligation to update any such information. D2C Media further assumes no liability with respect to any errors or omissions in the content of this website. Everything provided on this website is done so on an “as is” and “as available” basis. In the event of a difference between the specifications of any products and services herein offered and the specifications provided by the manufacturers of said products and services, the specifications provided by the manufacturers take precedence. Responsibility for validating the accuracy of all specifications before concluding a transaction rests with the user.
